Acknowledgement Of Risks

I acknowledge that I have been made fully aware that the Hot Chip (Single Corn Tortilla Chip) is coated with some of the hottest chilli peppers and chilli extracts on earth (including Carolina Reaper, Trinidad Moruga Scorpion, Naga Bhut Jolokia, Habanero, Black Pepper Extract), with an extreme degree of heat that may be as high as 2.2 million Scoville Heat Units.

I acknowledge that there are risks of personal injury, illness (which may include, but are not limited to: temporary loss of speech, blurry vision, breathing difficulty, diarrhoea, nausea, vomiting, abdominal pain, general indigestion, general aches, pain from burning sensations or the like), possible loss of life, loss of earnings, and risks of damage to or loss of personal property, which may result from consuming some or all of the Hot Chip. Capsaicin residue may irritate skin or eyes on contact (including allergic reactions); there is a choking risk if the chip is not chewed thoroughly.

I voluntarily agree to assume all risks, foreseeable or otherwise arising from participation. I release, indemnify, defend and hold harmless PrimoWireless Ltd (“Primo”), Smok’n Comrades Ltd, the New Zealand Barbecue Alliance, event staff, volunteers, sponsors and their representatives and agents of any of the aforesaid entities ("Released Parties") from any and all claims, liabilities, injuries, losses or damages, including legal fees, relating to, arising from or in connection with consuming the Hot Chip.

I acknowledge that eating the Hot Chip may exacerbate certain health conditions including, but not limited to heart conditions, irritable bowel syndrome, ulcers, or any other digestive condition and I release the Released Parties from any responsibility for the exacerbation of any conditions I currently suffer under, including but not limited to those listed above.

I Confirm That:

• I am 18 years of age or older.
• I am consuming some or all of the Hot Chip as a volunteer of my own free will and I have not received any pressure from any person to participate.
• I understand that I will not receive, and should not expect, any direct payment or financial compensation for participating in the Primo Hot Chip Challenge. However, I acknowledge that participation offers an opportunity to win prizes, which may include items or services with a monetary value.
• I waive my right to privacy under the Privacy Act 1993.
• I do not suffer from any known physical or mental condition that will endanger me if I participate and that I am in good general health.
• I am not pregnant.
• My judgement is not currently impaired by being under the influence of drugs or alcohol.
• I have been offered the opportunity to obtain independent medical and legal advice prior to consuming a Hot Chip but I have declined to do so.
• I have had the opportunity to ask questions about the Challenge and my participation.

Consent To Medical Treatment

I hereby give consent for emergency medical care provided by a qualified Doctor of Medicine or any emergency response medical care.

Intellectual Property Rights Waiver

I give Primo permission to photograph and film me before, during and after consumption of the Hot Chip, and I grant Primo full and forever permission to edit and use my photograph and any recordings of me and use my name for the purposes of publicity and marketing of the Hot Chip Challenge. I waive any intellectual property rights relating to any photograph or recording of me and I agree to the distribution of any photograph or recordings made of me of any media platform at any time.

Rules Of The Hot Chip Challenge

• Only 20 spots available – first in, first served.
• Challengers will compete in one of five Hot Chip heats.
• The winner of each heat will move through to the Final.
• You must wear the glove supplied and avoid touching your face.
• Consume half – one full Hot Chip, then wait.
• Participants must not eat, drink or chuck during or immediately (up to 10 mins after finishing the chip) after the challenge otherwise they will be disqualified.
• The winner will be deemed the person to last the longest without eating or drinking or chucking.
• If a tiebreaker results, the remainder of the chip is consumed.
• Participants must remain at the event table during their heat and are not allowed a toilet break or any other sort of break during the challenge.
• Follow all instructions from the MC, marshals and safety staff.
• Stop immediately if instructed or if feeling unwell.
• All participants receive a participation certificate; each heat winner receives $50 voucher for Smok’n Comrades. The overall winner from the Final will win 12 months free internet from Primo and full Hot Chip Challenge bragging rights!
• Primo also reserves complete discretion regarding all challenge related matters including qualification and disqualification. Primo also reserves discretion regarding disqualification of a participant which shall be subject to the sole and exclusive right of Primo. Participants have no rights of appeal.
